OPEN-SOURCE NOTICES ADDENDUM

This Open-Source Notices Addendum (“Open-Source Addendum”) forms part of the Shobbl Master Terms of Use, and applies to all Shobbl services, software, APIs, SDKs, developer tools, client applications, and related documentation (collectively, the “Services”).
This Addendum is incorporated by reference into, and governed by, the Master Terms of Use and any applicable agreements, policies, or addenda. In the event of a conflict, the Master Terms of Use control except where an applicable open-source license expressly requires otherwise.
1. PURPOSE & SCOPE
Shobbl’s Services may include or depend upon third-party software components that are subject to open-source or source-available licenses (“Open-Source Software”).
This Addendum:
provides notices required by applicable open-source licenses;
identifies how such licenses apply to Shobbl’s Services; and
clarifies the relationship between open-source license terms and Shobbl’s proprietary software, services, and content.
2. OWNERSHIP & SEPARATION OF RIGHTS
2.1 No Transfer of Proprietary Rights
Except as expressly stated in an applicable open-source license:
Shobbl retains all right, title, and interest in its proprietary software, platform infrastructure, services, APIs, content, documentation, trademarks, and branding; and
nothing in this Addendum grants any license to Shobbl’s proprietary materials.
Open-Source Software is licensed, not sold, under the terms of the applicable open-source license.
2.2 No Open-Sourcing of Shobbl Platform
The inclusion or use of Open-Source Software within the Services does not:
render any portion of Shobbl’s platform open source;
require Shobbl to disclose source code beyond what is expressly required by the applicable open-source license; or
grant any rights to reverse engineer, extract, or redistribute Shobbl proprietary code or systems.
3. OPEN-SOURCE LICENSES
3.1 Applicable Licenses
Open-Source Software used by Shobbl may be licensed under one or more of the following (non-exhaustive examples):
MIT License
BSD License (2-Clause or 3-Clause)
Apache License 2.0
ISC License
Mozilla Public License (MPL)
GNU Lesser General Public License (LGPL)
Other permissive or weak-copyleft licenses
Each Open-Source Software component is governed solely by its own license terms.
3.2 License Text Availability
Where required, the full text of applicable open-source licenses and copyright notices will be made available:
within the Services;
in accompanying documentation;
in an “Open-Source Notices” or “Licenses” file; or
via a publicly accessible notice page maintained by Shobbl.
4. COMPLIANCE WITH OPEN-SOURCE LICENSES
Shobbl complies with applicable open-source license obligations, including attribution, notice, and license availability requirements.
To the extent required by an applicable license, Shobbl will make available:
license texts;
copyright notices; and
limited source code or modification disclosures, where legally required.
Nothing in this Addendum expands Shobbl’s obligations beyond what is required under the applicable open-source license.
5. NO WARRANTY FOR OPEN-SOURCE SOFTWARE
OPEN-SOURCE SOFTWARE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR TITLE, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
This disclaimer applies regardless of whether the Open-Source Software is used independently or as part of Shobbl’s Services.
6. LIMITATION OF LIABILITY
To the maximum extent permitted by law:
Shobbl shall not be liable for damages arising from the use of Open-Source Software, except as required by applicable law or the applicable open-source license; and
any liability relating to Open-Source Software is limited as set forth in the Master Terms of Use.
Some open-source licenses may include their own limitation or exclusion of liability provisions, which apply to the Open-Source Software governed by those licenses.
7. NO SUPPORT OBLIGATION
Unless expressly stated in writing:
Shobbl does not provide support, maintenance, or warranties for Open-Source Software as such; and
any support provided relates only to Shobbl’s Services as a whole, not to individual open-source components.
8. THIRD-PARTY BENEFICIARIES
Certain licensors of Open-Source Software may be intended third-party beneficiaries of the applicable open-source license terms, but not of the Master Terms of Use or this Addendum.
9. CHANGES TO OPEN-SOURCE COMPONENTS
Shobbl may update, replace, or remove Open-Source Software components at any time as part of platform development, maintenance, security updates, or compliance efforts.
Such changes do not modify the license terms applicable to previously distributed Open-Source Software.
10. GOVERNING LAW
This Open-Source Addendum is governed by the same governing law and dispute resolution provisions as the Master Terms of Use, except where an applicable open-source license requires otherwise.
